Seattle EMTs and firefighters work under dual obligation. Washington's state OSHA program (WISHA), operated by the Department of Labor and Industries, enforces workplace bloodborne pathogen standards under Washington Administrative Code 296-823. The Washington State Department of Health EMS & Trauma Section enforces professional certification under RCW 18.73 and WAC 246-976. These are two independent systems. WISHA inspectors investigate employer compliance; DOH EMS enforces professional certification standards. Both can act on the same exposure incident independently. Washington was the first state in the US to implement a full state OSHA program (1971), and its regulatory structure reflects that heritage — comprehensive, parallel, and independently operating.

The Washington State Department of Health mandates under RCW 18.73 and WAC 246-976 that all EMTs and paramedics comply with bloodborne pathogen protocols and Standard Precautions. DOH can investigate and discipline individual first responder certifications for failure to maintain safe practices. If a Seattle EMS provider fails to implement proper exposure prevention measures, DOH can investigate and discipline the certification independent of WISHA's investigation of the employer.

WISHA enforces WAC 296-823, Washington's own bloodborne pathogen standard. Every Seattle EMS and fire agency must maintain annual training covering bloodborne exposures, offer Hepatitis B vaccine, maintain written Exposure Control Plans, keep sharps injury logs, and retain 30-year exposure records. WISHA has dedicated resources for enforcement in EMS and firefighting settings. When an exposure occurs, WISHA will investigate whether the agency documented the incident, arranged medical evaluation, provided training, and maintained the required components. Absence of any component is a separate violation. WISHA penalties for serious violations match federal OSHA's structure.
