The North Carolina Department of Labor operates its own state OSHA plan (OSHNC) to enforce workplace safety standards for all private-sector employers in Charlotte and across the state. OSHNC enforces standards at least as effective as Federal OSHA's requirements, including bloodborne pathogen compliance under standards equivalent to 29 CFR 1910.1030. North Carolina's regulatory structure means that OSHNC inspectors, not Federal OSHA inspectors, enforce at Charlotte esthetic salons. The North Carolina Board of Cosmetic Art Examiners (21 NCAC 14H) independently licenses and regulates all estheticians under state statute G.S. Chapter 88B. Both agencies can cite Charlotte salons for the same incident.

North Carolina Board Rule 21 NCAC 14H .0403 establishes mandatory disinfection procedures for esthetician tools: "Disinfectant, as applicable in this Subchapter, is defined as a disinfectant that is EPA registered as effective against: (1) bacteria including Staphylococcus aureus, MRSA, and pseudomonas aeruginosa; (2) viruses including HIV, Hepatitis B and C; (3) fungi including Trichophyton mentacrophytes." The rule explicitly names MRSA, HIV, Hepatitis B and C—one of the most specific pathogen lists in any state board rule. North Carolina also requires that students must pass the infection control and blood exposure procedures evaluation with 100% before performing on live clients—the highest pre-license gate of any state.

OSHNC requires annual training covering esthetician-specific bloodborne pathogen exposure routes (waxing, extractions, dermaplaning, microneedling, chemical peels), Hepatitis B vaccination offer, written exposure control plans, and 30-year records. OSHNC conducts inspections and issues citations. North Carolina's state standards are "at least as effective" as federal standards, so OSHNC enforcement has the same rigor as Federal OSHA. A single blood exposure incident can result in both OSHNC citations and board discipline from the NC Board.
